Terms and Conditions – Erasmus Life Porto


1. Object and Scope

Erasmus Life Porto is a brand held and operated by Associação International Life Lisboa (hereinafter the (“Association”), dedicated to organising and promoting events, parties, trips and other leisure, social and touristic activities aimed at Erasmus and international students, exchange students and young professionals in Porto.


These General Terms and Conditions (“Terms”) govern access to and use of the Erasmus Life Porto website, the acquisition of the Erasmus Life Porto & Erasmus Life Porto Card (including any Card Pack and associated vouchers), and the booking, payment and participation in any event, trip or activity promoted under the Erasmus Life Porto brand.


By booking any activity, trip, event or membership through Erasmus Life Porto, the user/participant declares that they have read, understood and unconditionally accepted these Terms. No exceptions to these Terms will be applied or given, under any circumstances.


Should the user disagree with any provision of these Terms, they must refrain from purchasing the membership card, making a booking, or participating in any event or trip promoted by Erasmus Life Porto.


2. Identification of the Entity

For the purposes of these Terms, the following entity intervenes: Associação International Life Lisboa, the association holding the “Erasmus Life Lisboa” and “Erasmus Life Porto” brands, hereinafter referred to as “the Association” or “Erasmus Life Porto”, with office at Rua João das Regras 223, 4000-290 Porto, Portugal, contactable through info@erasmuslifeporto.com.


3. Definitions

For the purposes of these Terms, the following definitions shall apply:

•  “Event” – any party, social gathering or one-off activity organised or promoted under the Erasmus Life Porto brand.

•     “Trip” – any excursion, tour or travel programme (single- or multi-day) organised or promoted by the Association, including, among others, trips to the Algarve, Lisbon, Spain, Serra da Estrela, Morocco and the Boat Party.

•     “Member” – holder of a valid Erasmus Life Lisboa & Erasmus Life Porto Card.

•     “Non-Member” – participant who purchases a ticket for an Event or Trip without holding the membership card, subject to the eligibility conditions set out in Clause 4.

•     “Participant” or “Student” – any person who books, pays for or takes part in an Event or Trip, or who purchases the membership card.

•     “Ticket” – the access title, obtained through booking and payment, entitling the Participant to take part in a specific Event or

Trip.

•     “Card” or “Membership Card” – the Erasmus Life Lisboa & Erasmus Life Porto Card, issued in one of the Card Packs described in

Clause 5.

•     “Card Pack” – the Standard, Plus or Premium version of the Card, each offering a different set of benefits as described in Clause 5.

•     “Voucher” – a discount credit included in certain Card Packs, redeemable strictly under the conditions set out in Clause 5.



4. Eligibility and Membership

The Erasmus Life Lisboa & Erasmus Life Porto Card (“Membership Card”) is reserved for:

•     International students under a mobility programme (for

example, Erasmus, Erasmus+, Erasmus Mundus, or other exchange/intercâmbio

programmes);

•     Young professionals (under 28 years old) from an EU country currently residing in Portugal;

•     International students currently enrolled in a Portuguese university or equivalent higher-education institution. The membership fee is non-refundable under any circumstances. Tickets for Non-Members are reserved for the categories identified above, and additionally for:

•     Portuguese nationals enrolled in a university who have previously participated in a mobility programme. At the check-in of any Event or Trip, the Participant may be required to show proof that they fall within one of the eligible categories listed above. Participants who do not fall within one of these categories, and/or who cannot prove it when requested at check-in, are not eligible to purchase any of the Association's services or products, and may therefore be refused entry to or participation in the Event or Trip. In such cases, a refund may or may not be issued, depending on the contractual

obligations existing between the Association and its partners for that specific

Event or Trip.


5. Erasmus Life Porto Card Packs and Vouchers

The Membership Card is made available in different Card Packs (Standard, Plus and Premium), each granting a different level of benefits as advertised by the Association from time to time. Card Packs are purchased through the Association's designated ticketing partner. Once purchased, Card Packs are non-refundable under any circumstances. Certain Card Packs include discount Vouchers. Vouchers must be requested in advance by email to elpvouchers@gmail.com, indicating the activity and date chosen, and may only be used for bookings made through the Association's online booking channels; they cannot be redeemed in person or for any other form of booking. Vouchers are non-refundable under any circumstances. The Membership Card is valid for six (6) months from its date of activation and may be renewed free of charge for a further six (6) months. Cardholders wishing to renew must contact the Association by email at least one month before the membership's expiry.


6. Bookings and Responsibility for Information Provided

When a Member or Participant makes a booking, they are required to fill in the Association's online form, indicating the Trip or Event in which they will take part and the corresponding date. It is the sole responsibility of the Participant to ensure that the information entered in the online form is correct.

If a Participant misses, is forced to cancel, or is refused participation in a Trip or Event due to an error in the date or any other information entered in the online form, the Cancellation Policy set out in Clauses 10 and 11 below shall apply in full, with no exceptions.


7. Taxes

All taxes are included in the base price of all Trips and Events.


8. Promotions and Sale Offers

Promotions and sale offers are launched within defined date periods and are available exclusively to Members of the Association. Promotional prices are not available before or after the stated start and end dates.


9. Online Booking Fees

Bookings, ticket purchases and Membership Card purchases made through the Association's online ticketing partner are subject to an operating fee charged by that partner, covering payment processing, billing and ticket-management services, and enabling the provision of fast and efficient customer support. This operating fee relates to a service that has actually been provided to the Participant at the time of booking and is therefore non-refundable under any circumstances, including

where the Trip, Event or Card purchase is otherwise refunded in accordance with these Terms. By completing checkout with the Association's ticketing partner,

the Participant additionally accepts that partner's own terms and conditions, under which transaction fees are likewise non-refundable.


10. Cancellation by the Participant / No-Show

All Members must notify the Association in writing or by email if they wish to cancel a Trip or Event. Participants who cancel their booking up to 10 business days before the departure date of the Trip or Event shall receive a 100% refund of the amount paid (excluding any non-refundable online booking fee under Clause 9), provided they present the receipt originally given (including the card payment receipt, where the Trip or Event was paid by card). Trips longer than one day – such as, among others, the trips to the Algarve, Lisbon, Spain and Serra da Estrela, Morocco – must be cancelled at least 15 business days before departure for this refund policy to apply. Participants who cancel their booking 10 business days or less before the departure date (or, for the multi-day Trips referred to above, 15 business days or less) shall receive no refund, under any circumstances. The Association is not responsible for, and will not issue a refund in respect of, cancellations due

to illness, strikes, acts of terrorism, adverse weather conditions, war, or any other sudden, uncontrolled event, nor in the event that a Member fails to show up on the day of the Trip or Event, whether due to sudden illness, an error made when entering the date in the online form, adverse weather, war, acts of terrorism, strikes, or any other uncontrolled event. Instead of cancelling, a Participant may transfer their place to another Member up until one week before the departure date of the Trip or Event. In such cases, it is mandatory to inform the Association's office so that the tickets can be changed. Ticket changes are offered at a service cost.


11. Cancellation or Date Change by the Association

If the Association must change the date of an Event or Trip for any reason, the Event or Trip shall be rescheduled to a later date free of charge. A Participant who had already booked for that Event or Trip and who cannot attend on the new date shall receive a 100% refund (excluding any non-refundable online booking fee under

Clause 9), provided they notify the Association within 72 hours of the change notification and present the receipt originally given on purchase (including the card payment receipt, where applicable). If the Association receives no notification from the Participant within this period, the Participant shall be automatically deemed willing and able to attend on the new date, and the regular Cancellation Policy set out in Clause 10 shall apply to the new date.


12. Trip and Event Date Changes Requested by the Participant

Trip or Event date changes requested by the Participant are allowed free of any extra charge, provided at least 5 business days' notice is given before the original departure date. There is no right to a refund arising from a subsequent cancellation following a date change; the regular Cancellation Policy set out in Clause 10 does not apply to such cancellations.


13. Reimbursement of Trips and Events Cancelled by the Association

Refunds must be collected within 1 week of the refund being confirmed by the Association's management. After this period, the refund shall be cancelled and no exceptions shall be given.


14. Changes in Itinerary

The itinerary of a Trip or Event is subject to change at any moment where this is unavoidable or beyond the Association's control. Such changes may include, but are not limited to, delays in transportation due to poor weather or traffic, changes of hotel made by the tour operator, changes made by the bus company, or changes to the order of visits and tours.


15. Personal Travel

The Association is not responsible for personal travel arrangements not included in its combined Trips, such as connections to the Participant's city of origin. The Association is not responsible for, nor will it refund, any costs of personal travel arising from itinerary changes that may occur on its Trips or Events, or for any other

reason.


16. Accommodation

Accommodation on combined overnight Trips is provided on a variable basis of double, triple, quadruple or higher occupancy, and sharing of double beds may be necessary. A supplement charge applies for individual rooms and, in some cases, for double rooms, depending on the Trip; supplement charges vary.


17. Special Requests

The Association will always do its best to accommodate special requests, such as rooming, bus allocation, or special meals. However, special requests are never guaranteed.


18. Visas and Identification Documents

Most EU citizens do not need a passport to take part in the Association's Trips and may travel using their country's identity card. Participants should ask the Association's staff or guides to confirm that their identity document is valid for the Trip in question. Passports and/or identity cards must be valid and up to date.

Certain nationalities are required to obtain a visa, in addition to their passport, for certain Trips. Participants who are unsure whether they need a visa should ask the

Association. The Association is not responsible for any problems that may occur at customs/border control due to an invalid or outdated passport, identity card

or visa; any resulting fees shall be paid by the Participant and not by the Association.


19. Code of Conduct

By taking part in any Event or Trip, the Participant agrees to behave respectfully and responsibly towards other Participants, the Association's staff and guides, venue staff, and the staff or crew of any partner operator, and to follow all instructions given by them at all times. The Association reserves the right to refuse entry to, or to remove without refund, any Participant whose conduct — including, without limitation, aggressive, threatening, discriminatory or abusive behaviour, excessive intoxication, damage to property, or any other breach of this Code of Conduct or of applicable venue or transport rules — endangers or disrupts the Event or Trip, or the safety or enjoyment of other Participants or staff. A Participant removed under this Clause shall not be entitled to any refund of the Event or Trip price, or of any related Membership Card, Card Pack or Voucher benefit, and shall remain liable for any damage caused in accordance with Clause 20.


20. Liability and Assumption of Risk

The Association is not responsible for illness, damage caused, lost items, or injuries occurring during or after its Events and Trips. If a Student causes damage to

another person's property, or to another person, the Student responsible shall be liable for paying the corresponding damages. By booking and taking part in an

Event or Trip, the Participant acknowledges that certain activities (including, without limitation, boat parties, outdoor excursions and social events involving alcohol) carry inherent risks, and voluntarily assumes such risks, undertaking to behave responsibly, to follow the instructions given by the Association's staff, guides, or the crew/staff of any partner operator, and to consume alcohol, where applicable, responsibly.


21. Photography and Image Rights

The Association holds the rights to all pictures taken during such Events. By taking part in an Event, the Participant waives all rights regarding the use of these pictures. The same pictures may be posted on the Association's website, Facebook, Instagram and other social media pages, and may be used in the production of promotional material for the Association, including for the Erasmus Life Porto brand.


22. Personal Data Protection

Personal data provided by Participants when purchasing the Membership Card or booking an Event or Trip is processed by the Association for purposes of managing the membership, bookings, payments, check-in, and communication of information relevant to the Event or Trip, in accordance with applicable data protection legislation, namely Regulation (EU) 2016/679 (General Data Protection Regulation) and Law No. 58/2019, of 8 August. For any questions regarding the

processing of personal data, or to exercise any rights available under the applicable legislation, Participants may contact the Association at info@erasmuslifeporto.com.

23. Complaints and Dispute Resolution

The Association makes available to consumers the legally required means for submitting complaints, including the Electronic Complaints Book (Livro de Reclamações Eletrónico), available at www.livroreclamacoes.pt. Pursuant to Law No. 144/2015, of 8 September, in the event of a consumer dispute, the Participant/consumer may resort to an Alternative Dispute Resolution (ADR) entity. Updated information regarding the ADR entities competent for the Association's activity and geographical area is available on the Consumer Portal (www.consumidor.pt). Recourse to the ordinary courts, as set out in Clause 24 below, remains available to any Participant who prefers to submit a dispute to the competent judicial courts.

24. Applicable Law and Jurisdiction

These Terms and the contractual relationship arising from them shall be governed by Portuguese law. The courts of the Porto Judicial District shall have jurisdiction to settle any dispute arising from or in connection with these Terms, without prejudice to any mandatory legal provisions protecting consumers that establish a different competent jurisdiction.

25. Final Provisions

These Terms constitute the entire agreement between the Participant and the Association in relation to their subject matter, superseding any prior understanding or agreement, whether oral or written, relating thereto. The nullity or unenforceability of any provision of these Terms shall not affect the validity of the remaining

provisions, which shall remain in full force and effect. The Association reserves the right to amend these Terms at any time. Amendments shall be published on the

Erasmus Life Porto website and shall take effect immediately upon publication (or on the date indicated therein). Participants are advised to consult these

Terms periodically to stay informed of any updates. Continued use of the website, or the making of new bookings following an amendment to these Terms,
